| | | | | | | | Subject: Set Public Hearing Date for Easement Vacation - 1325 Meadow Court | | |
| | | | | | | | Policy/Action Requested: Approve Resolution No. R2018-085, a resolution setting the public hearing date to consider the vacation of a 25-foot-wide public drainage & utility easement for property located at 1325 Meadow Ct. (northwest corner of Meadow Ct. & Jennifer Lane). | | |
| | | | | | | | Recommendation: Staff recommends that the Council adopt the attached resolution setting a public hearing date for the vacation of a public drainage & utility easement for property located at 1325 Meadow Ct. (northwest corner of Meadow Ct. & Jennifer Lane). | | |
| | | | | | | | Discussion: Eternity Homes, LLC is proposing the construction of a single family residential structure on this lot, and would like to utilize the area of the lot as allowed by setbacks. There exist two easements over the east portion of the property – a 10-foot drainage and utility easement recorded with the Prairie Meadows plat, which created the lot in question. Previous to this plat, there was a 25-foot easement that was part of the original Jennifer Lane construction. That 25-foot easement is no longer needed by the City and County; therefore, staff has shared with the builder the process for vacating that unnecessary easement.
The attached Resolution No. R2018-085 sets a public hearing date of Tuesday, August 21, 2018 to consider the vacation of a public drainage and utility easement. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration. The Planning Commission will consider the request at its August 9, 2018 meeting.
