Conduct a public hearing and adopt Resolution No. R2018-095, a resolution approving a vacation of the 25-foot public drainage & utility easement for property located at 1325 Meadows Court (Lot 10, Block 1, Prairie Meadows).
Recommendation:
Staff recommends that the Council adopt the attached resolution approving the vacation of the 25-foot public easement for property located at 1325 Meadow Ct. (northwest corner of Meadow Ct. & Jennifer Lane).

Planning Commission Recommendation
On August 9, 2018, the Planning Commission by a 4-0 vote recommended approval of the vacation of the 25- foot public drainage & utility easement for property located at 1325 Meadows Court (Lot 10, Block 1, Prairie Meadows).
Discussion:
John Anderson, Eternity Homes, LLC, is requesting that the City Council approve a vacation of the 25-foot wide public easement for property located at 1325 Meadow Ct. (northwest corner of Meadow Ct. & Jennifer Lane).

Eternity Homes, LLC own property located at 1325 Meadow Ct. (Lot 10, Block 1, Prairie Meadows), and would like to construct a home consistent with the zoning setbacks established for this parcel (30-foot setback off Meadow Ct. & a 20-foot setback off the Jennifer Lane property line). There exist two easements along the east line of that lot adjacent to Jennifer Lane; a 10-foot drainage & utility easement dedicated with the Prairie Meadows plat, and an underlying 25-foot easement from the Right-of-way plat when Jennifer Lane was first established. That 25-foot easement was set aside for a roadside ditch as Jennifer Lane was constructed as a rural roadway. The roadway has now been improved to an urban design and the City and SPUC concur that the 25-foot easement is no longer necessary. However, the 10-foot drainage & utility easement from the Prairie Meadows plat shall remain.

A public hearing has been set for Tuesday, August 21, 2018. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration.
