Shakopee City Council
September 18, 2018

FROM:Joe Widing, Planner
TO:Mayor and Council Members
Subject:
Annexation of property at 12675 Marystown Road.
Policy/Action Requested:
The Planning Commission at the August 9, 2018 meeting reviewed the request and by a vote of 4-0 recommended that the City Council approve the proposed annexation at 12675 Marystown Road.
Recommendation:

Adopt Resolution R2018-108, a resolution annexing property located at 12675 Marystown Road into the City of Shakopee.

Discussion:

Ann Spanish with the Shakopee Veterinary Clinic has made an application to request the annexation of an approximately 5-acre property at 12675 Marystown Road, including the adjacent right-of-way of Marystown Road to support their continued operations on the property and a future expansion to accommodate increased business. The subject property is approximately 4.78 acres, and is located east of Marystown Rd. and south of 17th Avenue. It is directly across Marystown Road from the Mt. Olive Evangelical & Lutheran Church and roughly 600 feet east of the now approved Windermere South development,  which has prompted the veterinary clinic to move for annexation and inclusion into the MUSA boundary in order to connect to water service and sanitary service when available for a planned expansion.

The business operation will continue as it has since 1973 as a veterinary clinic. The clinic plans to build an expansion in the near future, as is shown conceptually on the attached site plan. The expansion is planned to be roughly 5,000 square feet and be oriented on the western half of the property, north of the existing building, nearer to Marystown Road. Before a new building is constructed, a Conditional Use Permit for a veterinary clinic will be required. It is anticipated the applicant will be applying for this CUP for consideration at the Board of Adjustment and Appeals' November 8th meeting.

The property, while being outside the city boundaries, is within the area identified in the orderly annexation agreement made between the City and Jackson Township. The requirement for consideration of annexation states that for a property owner initiated annexation, the subject property needs to share a boundary with Shakopee’s municipal boundary and that shared border needs to be at least 50 lineal feet. The subject property meets this requirement with all 300 lineal feet of its west property line being shared with the City along Marystown Road.

Staff, the applicant and outside agencies have spent considerable time reviewing and discussing this submittal. Engineering and SPUC comments are attached and deal with the potential for connections to municipal sanitary and water services and are approving of the annexation with their conditions noted. The subject property will continue to be utilized as a veterinary clinic, with the possible future expansion in the near term and will have no significant impacts on the surrounding neighborhood as it is an existing business that has offered and will continue to offer vital services for Shakopee and Scott County pet owners for many years.
Budget Impact:

Per the Orderly Annexation Agreement, the City must pay Jackson Township seven years of the township portion of the property taxes for this property.
