Shakopee City Council
AugustĀ 8, 2018

FROM:Mark Noble, Senior Planner
TO:Mayor and Council Members
Subject:
Registered Land Survey (RLS) – Rahr Corporation
Policy/Action Requested:
Approve the requested Registered Land Survey, Resolution No. R2018-087, as proposed and move its approval.
Recommendation:
Staff is recommending that the RLS be approved conditioned upon the approval of the recording of the required drainage & utility easements.
Discussion:
The property in question is zoned Highway Business (B-1) and Heavy Industry (I-2) Zones. The purpose of the request is to consolidate the existing lot lines in order to clean up the complicated property configuration, and bring the property more into compliance with City Code standards (regarding setbacks, encroachments over property lines).

This RLS culminates the efforts to unify the Rahr Corporation property. In 2012, Rahr was approved of a vacation of rights-of-way (Resolution No. 7223) that vacated a significant number of streets and alleys that were created with the original City of Shakopee Plat (which was comprised of 60 x 142 foot lots). Over a significant amount of time, many of Rahr Corporation buildings were constructed in these public rights-of-way and over property lines. This RLS will correct those past conflicts.

The proposed tracts would exceed the minimum lot widths/lot depth requirements and bring those buildings more into compliance with the City Code minimum setbacks.

City Engineering, SPUC and Centerpoint Energy have commented that additional drainage & utility easements are required where existing and/or proposed services are/may be located. The applicant will prepare and record the required easements at the time of recording this RLS, should the Council approve this request.

Staff is recommending that the RLS be approved conditioned upon the approval of the recording of the required drainage & utility easements.
