Introduction
The City has made application to Reguide property to High Density Residential. The subject property is approximately 10.51 acres, and is located northeast of Sarazin Street & Downing Avenue.
The property owner, MWF Properties, LLC, previously was approved for preliminary and final plat of Sarazin Flats, as well as a conditional use permit for an over-height structure, and front yard setback, side yard setback and lot width variances in the R-3 Zone. The original proposal was for construction of two apartment buildings built in two phases; first phase for a 57 unit structure, and the 2nd phase for a 46 unit structure.
Due to an oversight, the comprehensive plan guiding is not consistent with the zoning (this situation has existed for at least 18 years, and was not corrected with either of the past two comprehensive plan updates in 1998 & 2008); however, the project density is not consistent with the existing guiding (max. 8 units/acre, where the project is proposed at approx. 10 units/acre) and a sewer permit can not be issued by the Metropolitan Council until this anomaly is corrected.
Considerations
The City Council may grant a zoning ordinance amendment when it finds that one or more of the following criteria exists:
1. The original zoning ordinance is in error.
2. Significant changes in goals in community goals and policies have taken place.
3. Significant changes in city-wide or neighborhood development patterns have occurred.
4. The comprehensive plan requires another provision.
Staff has determined that this amendment would bring consistency to the zoning & guiding and the proposed project and the request meets the criteria listed above; therefore, staff supports the proposed amendment. | | |
