Subject:
Vacation of Public Utility Easement - Scott County
Policy/Action Requested:
Approve Resolution No. R2019-004, a resolution approving the vacation of a 25-foot-wide public utility easement associated with the previously vacated Fuller Street (between 4th and 5th Avenues), conditioned that the applicant provides the recommended easements to the public as requested by City Engineering and SPUC.
Recommendation:
The Planning Commission, by a unanimous vote at their January 3, 2019 meeting, and Staff recommend that the City Council approve Resolution No. R2019-004, a resolution approving the vacation of a 25-foot-wide public utility easement associated with the previously vacated Fuller Street (between 4th and 5th Avenues), conditioned that the applicant provide the recommended easements to the public as requested by City Engineering and SPUC.
Discussion:
Wold Architects & Engineers is requesting on behalf of Scott County that the City Council approve their vacation of a 25-foot-wide public utility easement associated with the previously vacated Fuller Street (between 4th and 5th Avenues).

Wold Architects & Engineers is proposing the construction of an expansion to the Scott County Government Center & Justice Center on this property, and would like to utilize the area of the lot for construction of new building. Fuller Street has been vacated but a dedicated utility easement was reserved within this right-of-way. However, the Scott County Justice Center is presently located within this easement, and the construction of the new addition would encroach within that utility easement. As part of this expansion, this easement will no longer be needed by the City and Shakopee Public Utilities (SPU) provided the property owner relocates the existing underground electric services at their cost, and grants SPUC an underground electric easement.

At this public hearing, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration. City departments, Scott County and other outside agencies were given the opportunity to review and provide comments regarding this application. City Engineering and SPUC support the requests and have provided memorandums that list conditions of approval.
