Discussion:
Mr. Jack Hurst requested a vacation of the unimproved alley right-of-way within Block 5, East Shakopee. If the alley right-of-way is vacated, it will be equally divided among the neighboring lots.
Mr. Hurst's intention is to acquire the entire east-west portion of the alley as well as the portion of the north-south alley adjacent to the west of his property from his neighbors. Mr. Hurst would like to have the extra yard space in addition to providing an access to his property from Minnesota Street. Mr. Hurst does not intend to use the extra space for storage.
However, it would by up to Mr. Hurst to work out with the neighbors transfer of that property and there is no guarantee that will occur. Per regulations, each adjacent property owner will receive their share of the property adjacent to their property that is currently in right of ways.
City departments, Scott County and other outside agencies were given the opportunity to review and provide comments regarding this application.
The alleys and rights-of-way are not currently used for access and only contain utilities. The future use of the vacated property is addressed in the attached memos from Shakopee Public Utilities and the Engineering Department.
