Offer and pass a motion recommending approval of the vacation as recommended by staff. |

Staff recommends that the Planning Commission forward a recommendation of approval for the vacation of public drainage & utility easements for property located north of Eagle Creek Blvd., South of Shenandoah Drive and West of Vierling Drive @ 12th Avenue East, conditioned that the applicant provide the recommended easements to the public as referenced above by City Engineering, SPUC and CenterPoint Energy. |
| | | | | | | | Discussion:
Canterbury Development, LLC is proposing a development of this property that requires a new plat submittal in conjunction with this vacation of easements. If approved, the new plat will incorporate new easements consistent with City and utility requirements.
City departments, Scott County and other outside agencies were given the opportunity to review and provide comments regarding this application. City Engineering, SPUC and CenterPoint Energy support the requests, provided that the vacation be concurrent with new drainage & utility easements being granted with the Canterbury Park 9th Addition at the requested size and locations, and that a title search is conducted to confirm other interest from utility holders in any existing/underlying easements on the property.
SPUC is requesting a 20 ft. perimeter drainage and utility easement on the proposed 9th Addition plat, and CenterPoint Energy requests a similar easement that will cover their existing 4" gas main on this property.
A public hearing has been set for Tuesday, June 18, 2019. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration.
