| | | | | | | | Subject: Indemnification and Cooperation Agreement Regarding the Flying Cloud Airport | | |
| | | | | | | | Policy/Action Requested: Authorize approval of the final version of the Indemnification and Cooperation Agreement regarding the Flying Cloud Airport Joint Airport Zoning Board (JAZB) and the Flying Cloud Airport Zoning Ordinance. | | |
| | | | | | | | Recommendation: Staff recommends that the Council approve the action requested. | | |
| | | | | | | | Discussion: The Metropolitan Airports Commission (MAC), and the Cities of Eden Prairie, Chanhassen and Shakopee are all members of the Flying Cloud Airport Joint Airport Zoning Board (JAZB). The JAZB adopted the Flying Cloud Airport Zoning Ordinance on April 10, 2019 (effective date of May 1, 2019). MAC desires that an employee of each City act as the Zoning Administrator to administer and enforce the Ordinance within its respective boundaries, and that the Cities take action with respect to their comprehensive plan and zoning code to ensure awareness of and compliance with this Ordinance. In agreeing to enforce this Ordinance, the City of Shakopee desires to be protected against possible legal liability that may arise from their doing so, which this indemnification and cooperation agreement addresses. | | |
