It was anticipated in the original Contract for Private Development that the developer, Enclave, would assign its rights and duties to an affiliate since most developers build projects under limited partnerships that include other investors and partners.  Enclave has created DECO Shakopee LLC, a Minnesota LLC, to borrow and develop the former city hall site.  Per the previously approved agreement, the developer is allowed to ask the EDA to assign and assume its development rights to another affiliate.

The developer has provided the EDA/city with evidence of construction funding and has submitted final documents for its building permit.  It is anticipated they will close this month and begin construction.
