FROM:Kyle Sobota, Senior Planner

Subject:
Vacation of a Portion of the Vierling Drive West Right-of-Way / Drainage and Utility Easement In West Shakopee Gateway
Policy/Action Requested:
Adopt Resolution No. R2020-070.
Recommendation:
Adopt resolution as presented.
Discussion:

The City of Shakopee is proposing to vacate a portion of the Vierling Drive West right-of-way, along with a portion of drainage and utility easement that is on a property currently owned by the Shakopee Economic Development Authority.

Opus Development is proposing a speculative business park building on the site. The vacation involves a small portion of the right-of-way adjacent to the round-a-bout at the intersection of Vierling Drive and Lincoln Street (see attached site plan and vacation sketch). The portions of right-of-way and drainage and utility easement are not necessary for city operations and will allow for the location and design of the proposed building (see attached site plan). A drainage and utility easement is proposed to be dedicated in the area of the proposed right-of-way vacation, as well as a trail easement. By a vote of 6-0 the Planning Commission unanimously recommended City Council approval of the proposed vacation.
