Paul Tabone, representing Lennar Homes has applied to vacate a portion of an existing easement within the Ridge Creek subdivision. The easement is held by both the City of Shakopee and the Prior Lake - Spring Lake Watershed District. The location is near the Prior Lake - Spring Lake outlet channel and is depicted on the attached drawing.

The purpose of the vacation is that the watershed district and city no longer need the entire easement, and the extension of Crossings Blvd and some of the residential lots of Ridge Creek encroach into this easement area, so this vacation must be finalized prior to a final plat of any residential lots, or the right-of-way for Crossings Blvd.

The City Engineering Department has commented that there must be a proper easement over the channel area in the current, or a re-aligned channel location.  There is an existing easement for the current channel location. The Prior-Lake Spring Lake Watershed District is requiring Lennar to provide a revised easement suiting the needs of the watershed district. The watershed administrator has commented that they have reached a tentative agreement on the revision. The City of Shakopee Engineering Department states that the city's only need for an easement in this area is for the outlet channel area.
