Shakopee City Council
JuneĀ 16, 2020

FROM:Michael Kerski, Director, Planning and Development
TO:Mayor and Council Members
Subject:
Commercial Building Encroachment and Access Appurtenant Easement between the city and the Estate of Jerome J. Harieux and Eagle Creek Station LLC
Policy/Action Requested:
Motion authorizing the appropriate city officials to execute the Commercial Building Encroachment and Access Appurtenant Easement.
Recommendation:

Make motion to approve agreement.

Discussion:

This agreement will allow the property to have a clearer title should an owner sell or have to finance the acquisition or renovation.

This train station was constructed  in 1910 by the Omaha Milwaukee Railroad.  The structure encroaches into the right-of-way of Second Avenue and into the railway area.  The city of Shakopee owns both rights of way in this area of town.

The city attorney has been working with the estate of the current owner for several years to resolve the title issues.  The attached encroachment resolves the issues.
