Staff recommends approval of an agreement in order to construct the county highway improvements needed to serve the Windermere Development. The Construction Cooperative Agreement defines the cost sharing and project deliverables between the city and the county. A separate developer’s agreement will define the cost sharing and project deliverables between the city and the developer.

Approval of this agreement is necessary for the development of the area west of CSAH 15 and south of TH 169 to move forward.

Staff has negotiated with the developer and the county to develop the cost sharing agreement. The main items of the agreement include cost sharing, maintenance of trees in county right-of-way, and other project responsibilities.

Attached are the agreement and cost estimate with proposed cost splits as prepared by WSB and Associates who is providing the design of the county roads. The county and developer are in agreement with the cost splits as defined within the terms of the agreement.
