| | | | | | | | Subject: Registered Land Survey (RLS) – Former Train Depot (Harvieux)
| | |
| | | | | | | | Policy/Action Requested: Approve the requested Registered Land Survey, Resolution No. R2021-038, as proposed and move its approval. | | |
| | | | | | | | Recommendation: Approve the requested action. | | |
| | | | | | | | Discussion: Peter Oetliker, applicant, and Jerome Harvieux, property owner, have submitted a request for approval of their Registered Land Survey (RLS) for property located at the northeast corner of 2nd Avenue West and Scott St. South. This site is the location of the Eagle Creek Quilt Shop (former Train Depot).
The property in question is zoned Highway Business (B-1). The applicant has submitted this RLS as it is a requirement of registering the property Torrens. There is a registration proceeding pending (First Judicial District Court - Scott County, Case No. 70-CV-17-11871) regarding this property.
The property in question is non-conforming in size, with the existing structure non-conforming as well (setbacks); however, this structure was constructed in 1910 and this lot configuration has existed for a significant number of years. No changes are proposed other than to record this property under a Registered Land Survey.
City Engineering, City Finance Department and Comcast Cable have provided the following comments:
1. The property has a pending special assessment for $14,671.00 for the upcoming 2021 Street & Utility Reconstruction. Council approved this project on 2/16/2021.
2. Comcast Cable has utilities in the alley ROW.
3. Provide ten (10) feet of drainage and utility easement along property lines adjacent to public right-of-way.
4. Provide five (5) feet of drainage and utility easement along all remaining property lines not adjacent to public right-of-way.
Staff is recommending that the RLS be approved conditioned upon the approval of the recording of the required drainage & utility easements (staff & the applicant to discuss final configuration of easements prior to recording). The applicant shall prepare and record the required easements at the time of recording this RLS, should the Council approve this request.
