| | | | | | | | Discussion: Erich Hartwig is requesting that the Planning Commission forward to the City Council a recommendation approving the vacation of public drainage and utility easements as dedicated within his property located at 1850 Bass Circle (Lot 34, Block 2, Ridge View Estates).
Introduction
Mr. Hartwig is proposing to construct a detached accessory structure within a portion of this property that is encumbered by a public drainage & utility easement, which is located south of a Metropolitan Waste Control Commission sanitary sewer easement. This easement vacation is not of concern with City staff, and should the vacation be approved, a building permit would be required of the applicant to construct his desired building. This vacation would not impact the Metropolitan Waste Control Commission easement.
City departments and other outside agencies were given the opportunity to review and provide comments regarding this application. City Engineering and Planning staff support the request, provided that a title search is conducted to confirm other interest from utility holders in any existing/underlying easements on the property.
On Tuesday, June 15, 2021, the City Council will hold a public hearing to consider the vacation of the public drainage and utility easements. On that date, comments from staff as well as a recommendation from the Planning Commission will be presented to the City Council for consideration.
