| | | | | | | | Subject: Vacation of public drainage and utility easement as dedicated within Lot 34, Block 2, Ridge View Estates | | |
| | | | | | | | Policy/Action Requested: Approve Resolution No. R2021-095, a resolution approving the vacation of certain public drainage and utility easements as dedicated within Lot 34, Block 2, Ridge View Estates, as described in the attached Easement Descriptions exhibit and as depicted on the attached Easement sketch. | | |
| | | | | | | | Recommendation: The Planning Commission, by a 7-0 vote, recommended approval of the requested Vacation of easement. | | |
| | | | | | | | Discussion: Erich Hartwig is requesting that the City Council approve the vacation of public drainage and utility easements as dedicated within his property located at 1850 Bass Circle (Lot 34, Block 2, Ridge View Estates).
Mr. Hartwig is proposing to construct a detached accessory structure within a portion of this property that is encumbered by a public drainage & utility easement, located south of a Metropolitan Waste Control Commission sanitary sewer easement. This easement vacation is acceptable to City staff, and should the vacation be approved, a building permit would be required of the applicant to construct his desired building. This vacation would not impact the Metropolitan Waste Control Commission easement, city or SPU utilities.
City departments and other outside agencies were given the opportunity to review and provide comments regarding this application. City Engineering and Planning staff support the request, provided that a title search is conducted to confirm other interest from utility holders in any existing/underlying easements on the property.
