Policy/Action Requested:
Approve Resolution No. R2021-103
Recommendation:
Staff recommends approval of the resolution as presented. The Planning Commission recommended City Council approval of the vacation resolution by a vote of 7-0 on June 3, 2021.
Discussion:

The City of Shakopee is proposing to vacate a portion of public right-of-way in the plat DCCO First Addition. DCCO First Addition is a one lot plat from 1979 that is encompassed by the Seagate Technology site and was for a building / roadway that was razed to allow for the construction of Seagate Technology in the late 1990's.

A recent title review by the city attorney of the Seagate site for the EDA revealed an unresolved issue within an area of the southern parking lot. To clear up the title issue the City of Shakopee proposes to vacate the small segment of right-of-way to clear up the title issue on this site. The vacation of this segment of right-of-way was originally intended to be completed prior to construction of the Seagate building. Staff have not been able to locate records that the vacation of this right-of-way was completed or recorded as originally intended in the documents.
