Recommendation:

Discussion:
Ryan Lindquist and Damon Schuler, representing Shakopee BrewHall, have applied for a conditional use permit amendment for expansion of a taproom, brewery and tavern at 126 1st Avenue East in the B-3 Central Business Zoning District. The building was recently renovated (former Eagle Pet Center) with the Shakopee BrewHall located on the first floor and general business office space located on the 2nd floor. The applicants propose to expand their brewery into the patio area on the 2nd floor, accessible thru their production area and a stairway at the rear of the building.

In 2013, the City Council adopted ordinance language regarding breweries, micro-distilleries, wineries, and taprooms. Small Breweries with taprooms are a conditional use in the B-3 zone. A small brewery is defined as a brewery that produces no more than 20,000 barrels of malt liquor in a calendar year. The applicant does not anticipate brewing that much beer, as they are focused on small batch recipes and the opportunity for beer shares with other breweries. The minimum standards for small breweries as defined by code are that the waste products must be disposed of in a timely manner and in such a way to reduce odors and an annual production report shall be provided to the Planning Department.

The applicants propose to utilize the existing 2nd floor patio for additional outdoor seating (capacity of 30 persons). In order to comply with City and state requirements, no more than 30 individuals will utilize the 2nd floor at any one time (meaning the number of proposed BrewHall patrons will be reduced while the business office spaces are occupied). This patio area will incorporate televisions and a stereo system for the enjoyment of the patrons. The patio is proposed to be open between 3 p.m. and 11 p.m., and any noise produced by the patrons and the electronic devices will comply with City Code requirements.

In the B-3, Central Business District there are no off-street parking requirements. The site is adjacent to a public parking lot and is in close proximity to 2 other public parking lots. Typical days of operation are Wednesday thru Sunday, with hours generally between noon and midnight.

Planning staff received comments from several different departments/agencies, and have incorporated those comments in the draft resolution. Those conditions include the need for an access easement from the neighboring property owner (Turtle’s Bar and Grill), and the need for an amended liquor license for the brewery/tap room & tavern.
