| | | | | | | | Recommendation: Approve requested action. |
| | | | | | | | Discussion: City staff is requesting that the Planning Commission recommend approval of Ordinance No. O2021-023, an ordinance amending City Code 151.110, Zoning Performance Standards – Grading, Filling and Excavations by updating the ordinance to meet certain conditions pertaining to disturbance thresholds for grading, filling and excavations, Ordinance No. O2021-022, an ordinance amending City Code 151.007.J. (Zoning General Regulations), by updating the ordinance to meet certain conditions pertaining to standards related to Bluffs; and Resolution No. R2021-132, a resolution amending the Design Criteria for Chapter 151.
The Lower Minnesota River Watershed District performed a recent review to determine if the city’s official controls pertaining to surface water meet the requirements of the watershed. Their review indicated that the city is in general compliance but needs to clarify a few discrepancies. As part of the jurisdiction oversight of the watershed, the City’s controls must be updated to correct these minor discrepancies in order to provide the sole jurisdictional review for private developments and avoid a redundant review by the watershed. Once updated, the city will then be able to renew the municipal permit from the watershed to take on the local governing unit permitting.
Surface water control updates identified include: City Code 151.007, City Code 151.110, and the city’s Design Criteria. In addition to the required watershed updates relative to the Design Criteria, other “house cleaning” updates are proposed as indicated below.
The following is a general summary of the surface water regulatory and design criteria revisions:
City Code 151.007:
• Updated the threshold trigger requiring a grading permit to include a surface area disturbance of 5,000 square feet.
• Added condition to preserve general drainage patterns along bluffs.
• Added condition to not create stormwater basins along bluffs.
• Other minor edits.
City Code 151.110:
• Updated the threshold trigger requiring a grading permit to include a surface area disturbance of 5,000 square feet.
Design Criteria:
• Updated the threshold trigger requiring a grading permit to include a surface area disturbance of 5,000 square feet.
• Miscellaneous general updates and clarifications to better capture current practices and standards.
• Other minor edits.
The implications and effects of these changes are minor in nature and generally do not change how the city has already been managing the developments based on current controls, best management practices and other industry standards.
