|
| | | | | | | | | FROM: | Mark Noble, Senior Planner | | TO: | Planning Commission |
|
| | | | | | | | Subject: Vacation of Public Drainage and Utility Easement as dedicated within Outlot C, Summerland Place First Addition |
| | | | | | | | Policy/Action Requested: Offer and pass a motion recommending approval of the vacation of public drainage and utility easements as dedicated within Outlot C, Summerland Place First Addition, as depicted on the attached ALTA/NSPS Land Title Survey, with conditions as noted in the draft Resolution. |
| | | | | | | | Recommendation: Approve requested action. |
| | | | | | | | Discussion: Lennar Multifamily Communities, LLC are in the initial phases of having this parcel developed, and before they can submit for Plat approval, they are requesting the Vacation of the blanket easement over Outlot C, Summerland Place First Addition. Should this Vacation be approved, the developer of the property will provide new easements consistent with City Engineering, Scott County, and SPUC requirements.
City departments and other outside agencies were given the opportunity to review and provide comments regarding this application. City Engineering and Planning staff support the request, provided that a title search is conducted to confirm other interest from utility holders in any existing/underlying easements on the property and that new 10-foot drainage and utility easements be dedicated along those sections of Tyrone Drive and 17th Avenue East that are adjacent to Outlot C, Summerland Place First Addition.
On Tuesday, October 19, 2021, the City Council will hold a public hearing to consider the vacation of the public drainage and utility easements. On that date, comments from staff as well as a recommendation from the Planning Commission will be presented to the City Council for consideration.
