Policy/Action Requested:
Adopt Resolution No. R2021-144 for the vacation of public drainage and utility easements as dedicated within Outlot C, Summerland Place First Addition.
Recommendation:

On Thursday, October 7th, the Planning Commission reviewed this request and by a 5-0 vote, recommended approval.

Discussion:
Gene Hauer Farms, LP, property owner, and Lennar Multifamily Communities, LLC, applicant, are requesting that the Planning Commission forward to the City Council a recommendation approving the vacation of public drainage and utility easements as dedicated within Outlot C, Summerland Place First Addition.

Lennar Multifamily Communities, LLC is in the initial phases of having this parcel developed, and before they can submit for Plat approval, they are requesting the Vacation of the blanket easement over Outlot C, Summerland Place First Addition.

City departments and other outside agencies were given the opportunity to review and provide comments regarding this application. Scott County, SPUC and City Engineering & Planning staff support the request, provided that a title search is conducted to confirm other interest from utility holders in any existing/underlying easements on the property and that new 10-foot drainage and utility easements be dedicated along those sections of Tyrone Drive and 17th Avenue East adjacent to Outlot C, Summerland Place First Addition.
