Recommendation:
Staff and Planning Commission recommends adoption of Resolution R2022-056, a Comprehensive Plan amendment to Figure 4.12 - Planned Land Use in the 2040 Comprehensive Plan.
Discussion:

The City of Shakopee is proposing to amend Figure 4.12 - Planned Land Use in the 2040 Comprehensive Plan. The amendment would re-guide 3 parcels for a total of 6.82 acres from Mixed Employment Center to Entertainment District. The parcels are located at the Southwest corner of Unbridled Avenue and Canterbury Ave S. and currently consist of remnant piece of vacant land, stormwater pond and Sowles Company. The pond is used as a permanent detention basin for the roadways (CH 83 and Unbridled) and some of the adjacent undeveloped land and future roadways. The intent of the amendment is to allow for the construction of an outdoor amphitheater and other entertainment uses adjacent to Canterbury Park.

The following are the criteria evaluated in the granting of a Comprehensive Plan Amendment. The City Council may grant a Comprehensive Plan Amendment when it finds that one or more of the following criteria exists:

Criteria #1 The original zoning ordinance is in error.
Finding #1 The original zoning ordinance was in error. The parcels should have been guided as Entertainment District, consistent with the adjacent Canterbury complex. This Amendment remedies this error.

Criteria #2 Significant changes in community goals and policies have taken place.
Finding #2 Significant changes in community goals and policies that affect these properties have taken place.  The city expanded the redevelopment area to include these properties since the Comprehensive Plan was adopted.

Criteria #3 Significant changes in development patterns have occurred.
Finding #3 Significant changes in development patterns have not occurred for the subject properties.

Criteria #4 The Comprehensive Plan requires a different provision.
Finding #4 The comprehensive plan for the subject properties requires an amendment to the future land use designation to allow for the proposed amphitheater to be built in full.

Staff finds that the amendment meets 3 of the 4 criteria necessary to be approved by the City Council.
