Summergate Development, LLC is requesting that the Planning Commission forward to the City Council a recommendation approving the vacation of public drainage and utility easements as dedicated within Outlots A and B, Summerland Place First Addition.
Summergate Development, LLC has proposed development of their second phase of Summerland Place, and a condition of Plat approval is that they vacate the existing blanket easements over Outlots A and B of Summerland Place First Addition. Should this vacation be approved, the developer of the property will provide new easements in the Second Addition Final Plat consistent with City Engineering and SPU requirements.
City departments and other outside agencies were given the opportunity to review and provide comments regarding this application. SPU, City Engineering & Planning staff support the request, provided that a title search is conducted to confirm other interest from utility holders in any existing/underlying easements on the property and that new drainage and utility easements be dedicated with the final plat of Summerland Place Second Addition.
The attached draft Resolution provides conditions of approval of the requested action. The City Council will conduct a public hearing on Tuesday, April 19, 2022 to consider the vacation of the public drainage and utility easements. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration.
