Discussion:
During a review of the agreement for library services between the City of Shakopee and Scott County it was discovered that the current agreement dated in 1997 (attached) was for the previous city-owned library building on the site, and that an agreement had not been updated to include the current building. This posses a legal argument as to the viability of the current agreement.
In addition, the City wants to ensure that the library building is being used for those activities that are conducive to an active learning environment generally noted as traditional "library services" which although noted in the 1977 agreement, was not defined.
The updated license agreement (attached) offers clarity to activities that are allowed in the city-owned building, but also provides that if the County wishes to conduct other activities, they can ask the City Council for approval.
The agreement also makes clear that the City retains the right to use for its purposes any portion of the building that is not actively used by the County for library services.
The City will continue to provide all physical upkeep and utility expenses for the building, provide custodial services, address all grounds keeping and snow removal services and cover the insurance costs of the building. The County responsibility is to essentially operate the building as a library an provide the necessary items to do so.
