Policy/Action Requested:
Adopt Resolution R2022-088, a Comprehensive Plan amendment to Figure 4.12 - Planned Land Use in the 2040 Comprehensive Plan.
Recommendation:
Staff recommends that the Planning Commission give a positive recommendation for Resolution R2022-088, a Comprehensive Plan amendment to Figure 4.12 - Planned Land Use in the 2040 Comprehensive Plan.
Discussion:

The City of Shakopee is proposing to amend Figure 4.12 - Planned Land Use in the 2040 Comprehensive Plan. The amendment would re-guide 4.6 acres from Parks and Open Space to Suburban Residential. The 4.6 acres are located at the Northwest corner of Eagle Creek Boulevard/County Road 18 and currently consist of undeveloped open space. The intent of the amendment is to allow for the construction of Moraine Addition Community Land Trust, a development consisting of 15 single family homes.

The following are the criteria evaluated in the granting of a Comprehensive Plan Amendment. The City Council may grant a Comprehensive Plan Amendment with a two thirds majority when it finds that one or more of the following criteria exists:

Criteria #1 The comprehensive plan was in error.
Finding #1 The original zoning ordinance is on error. This was a mistake caused by the fact that the county did not plat the road. The parcels are owned by the county and extend through the road; they were guided as if they would not be developed when the intention was always to extend Moraine drive, which currently dead-ends.

Criteria #2 Significant changes in community goals and policies have taken place.
Finding #2 Significant changes in community goals and policies have not taken place.

Criteria #3 Significant changes in development patterns have occurred.
Finding #3 Significant changes in development patterns have not occurred.

Criteria #4 The Comprehensive Plan requires a different provision.
Finding #4 The Comprehensive Plan does not require a different provision.

Staff finds that the amendment meets 1 of the 4 criteria necessary to be approved by the City Council.
