Subject:
Vacation of Public Drainage & Utility Easements in Hentges Industrial Park 2nd Addition
Policy/Action Requested:
Recommend adoption of Resolution R2022-090 regarding the vacation of public drainage and utility easements as dedicated within Hentges Industrial Park 2nd Addition.
Recommendation:
Planning Staff recommend the Planning Commission forward a recommendation approving the requested easement vacations.
Discussion:
Hentges Development, LLC is requesting that the Planning Commission forward to the City Council a recommendation approving the vacation of public drainage and utility easements as dedicated within Hentges Industrial Park 2nd Addition.

Hentges Development, LLC has proposed development of their Hentges Industrial Park 3rd Addition, and with CT Realty proposing a CNG (compressed natural gas) facility on the proposed Lot 2 of that 3rd Addition. Since there was a realignment of the common line between Lots 1 & 2, new easements were required with the old easements required to be vacated. Should this Vacation be approved, the developer of the property will provide new easements in the Hentges Industrial Park 3rd Addition Final Plat consistent with City Engineering and SPU requirements.

City departments and other outside agencies were given the opportunity to review and provide comments regarding this application. City Engineering & Planning staff support the request, provided that a title search is conducted to confirm other interest from utility holders in any existing/underlying easements on the property and that new drainage and utility easements be dedicated with the final plat of Hentges Industrial Park 3rd Addition. SPU is requesting with the 3rd Addition a 15-foot utilities easement be established recognizing the existing overhead line with the same width of 15 feet and location. In addition, alongside the interior property lines of Lot 1 and Lot 2, Block 1, the drainage and utilities easement should be a minimum of 10 feet to be usable for “small” utilities.

The attached draft Resolution provides conditions of approval of the requested action. The City Council will conduct a public hearing on Tuesday, July 19, 2022 to consider the vacation of the public drainage and utility easements. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration.
