| | | | | | | | Policy/Action Requested: Adopt Resolution R2022-091 regarding the vacation of public drainage and utility easements as dedicated within Windermere South 5th Addition. | | |
| | | | | | | | Recommendation: The Planning Commission recommended approval of this request by a 5-0 vote at their July 7, 2022 meeting. | | |
| | | | | | | | Discussion: D.R. Horton, Inc. - Minnesota is requesting that the City Council approve the vacation of public drainage and utility easements as dedicated within Windermere South 5th Addition.
D.R. Horton, Inc. - Minnesota is proposing development of their Windermere South 6th Addition. The parcel in question (Outlot A, Windermere South 5th Addition) has a blanket easement over the entire parcel. To develop this parcel, Vacation of that public drainage & utility easement is necessary. Should this Vacation be approved, the developer of the property will provide new easements in the Windermere South 6th Addition Final Plat consistent with City Engineering and SPU requirements.
City departments and other outside agencies were given the opportunity to review and provide comments regarding this application. SPU, City Engineering & Planning staff support the request, provided that a title search is conducted to confirm other interest from utility holders in any existing/underlying easements on the property and that new drainage and utility easements be dedicated with the final plat of Windermere South 6th Addition.
