Shakopee City Council
December 20, 2022

FROM:Michael Kerski, Planning/Development Director
TO:Mayor and Council Members
Subject:
Sale of excess land while retaining necessary rights of way.
Policy/Action Requested:
Adopt Resolution R2022-161 for the sale of the property for $30,000 while retaining the necessary rights of way for an existing road.
Recommendation:
Adopt Resolution R2022-161
Discussion:

The subject property was acquired as part of the construction of roadways along CH 101/First Avenue by Scott County to provide access to the properties to the rear as part of the road reconstruction.

The adjacent property at 815 1St Avenue W is significantly higher in elevation than the current city property.  The existing railroad tie retaining wall at 815 is collapsing on to the city's property.  It is currently bowed out in several locations.

The city has worked with the adjacent property owner at 815 on solutions and the best solution would be for them to acquire the city's property with appropriate easements for the right of way for the existing road of Clay Street North.  The rights of way encompass about half of the property that is being sold.  The sale will allow the property owner to provide new grading and retaining walls to safely protect the existing business and parking lot on their property.

Budget Impact:
$30,000 will be returned to the city's property acquisition fund.
