Subject:
Vacation of Public Right-Of-Way within Glacier Estate
Policy/Action Requested:
Adopt Resolution R2022-155 regarding the vacation of certain public right-of-way (segment adjacent to Moraine Drive) as dedicated within Glacier Estates.
Recommendation:

Planning Commission Recommendation

The Planning Commission considered this request at their December 8, 2022 meeting and by a 6-0 vote, recommended approval of the requested right of way vacation.

Adopt Resolution R2022-155 regarding the vacation of certain public right-of-way (segment adjacent to Moraine Drive) as dedicated within Glacier Estates.

Discussion:
Scott County CDA has proposed development of land owned by Scott County adjacent to Glacier Estates (Moraine Addition). There is a small triangular shaped parcel of public right of way that was originally dedicated with Glacier Estates, to be used in combination with additional future right-of-way on the Scott County parcel as a second (emergency) access to this residential area. At this time, Scott County CDA is proposing a development of that property and the City suggested vacating this small segment to better realign the potential lots between Glacier Estates and Moraine Addition, along with better positioning the second (emergency) access for these two (2) subdivisions.

City departments and other outside agencies were given the opportunity to review and provide comments regarding this application. City Engineering & Planning staff support the request, provided that a title search is conducted to confirm other interest from utility holders in any existing/underlying easements on the property, vacation of right-of-way shall not impact the existing Emergency Access/Trail Easement that encompasses a portion of the area to be vacated, and dedicate Emergency Access/Trail Easement over the portion of trail currently located in the public right-of-way being vacated.

The attached Resolution provides conditions of approval of the requested action. Comments from staff members and utilities, as well as a recommendation from the Planning Commission, have been presented to the City Council for consideration.
