Shakopee City Council
February 7, 2023

FROM:Ryan Halverson, Assistant City Engineer
TO:Mayor and Council Members
Subject:
Agreement with MnDOT for the Trunk Highway 169 Pedestrian Bridge
Policy/Action Requested:
Authorize a Cooperative Construction Agreement between MnDOT and the City of Shakopee to construct the Trunk Highway 169 Pedestrian Bridge.
Recommendation:
Approval of the Agreement.
Discussion:

The City of Shakopee's 2022 Capital Improvement Plan contains the Trunk Highway 169 Pedestrian Bridge Project, CIF-22-002 (see attached CIP Sheet). City Council approved the plans and advertisement for bids on December 20, 2022. A public bid opening is scheduled for February 7, 2023, and City Council consideration of the bid award is anticipated on February 21, 2023.

Trunk Highway 169 is under the full jurisdiction of the Minnesota Department of Transportation (MnDOT). The attached Construction Cooperative Agreement with MnDOT will permit the City of Shakopee to construct the pedestrian bridge, bituminous trails, retaining walls, storm sewer, lighting and associated construction within the state right-of-way.

The pedestrian bridge will be owned by the City, but the State will share in some of the ownership responsibilities. The City will be responsible for all major structural related maintenance; joint flushing, deck crack sealing, painting, overlays, redecking and rehabilitation of the bridge structure, concrete bridge approach panels and retaining walls. Additionally, the City will be responsible for all minor maintenance such as snow removal, graffiti removal visible from the trail, trail paint striping and litter and debris removal. The State will perform bridge inspection and invoice the City for the inspection costs. Additionally, the State will be responsible for the guardrails below the bridge on TH169 and signage related to traffic for trunk highway.

The recommended Cooperative Construction Agreement will codify the initial construction and ongoing maintenance responsibilities of each agency, similar to and consistent with the many other City and MnDOT agreements.

Budget Impact:

The project is budgeted in the 2022 Capital Improvement plan and will be funded by the Capital Improvement Fund and through a State grant through bonding funds. Full project costs and funding will be reported and considered with the upcoming bidding process.
