Introduction
Westwood Professional Services, applicant, and NHA Partners – Shakopee, LLC, property owner have made application for Final Plat approval of Windermere East 1st Addition, a plat proposing a new 1.54 acre commercial lot on the east side of Windermere Way, north of 17th Avenue and west of Marystown Road. The proposed use is a day care/early learning school for up to 190 children. There are two outlots proposed with this final plat, which would require final plat approval prior to development.
D.R. Horton, Inc. – Minnesota received rezoning, reguiding, PUD and Preliminary Plat approval for the Windermere project in April, 2017. The First Addition was approved on July 18, 2017 and the 2nd Addition was approved on February 20, 2018. The proposed Lot 1, Windermere East 1st Addition is generally consistent with the approved Preliminary Plat, as are the two proposed outlots. The developer and staff have thoroughly reviewed the proposed project, and have developed a layout that complies with City regulations.
The applicant has also proposed a Conditional Use Permit request for the day care facility. This application will be reviewed by the Board of Adjustment and Appeals on March 8, 2018. The proposed project appears to generally comply with City Code design standards and is being recommended for approval by City staff. Both CUP and Final Plat approval/recording is required before this facility can receive building permit approval. Staff will conduct a thorough review of the building permit once submitted, and specific design details will be reviewed for compliance with the City Code Design Standards at that time, should this project be approved.
