Shakopee City Council
July 18, 2023

FROM:Mark Noble, Senior Planner
TO:Mayor and Council Members
Subject:
Annexation of Portions of Zumbro Avenue and Colburn Drive
Policy/Action Requested:
Adopt Resolution R2023-082, a resolution approving the annexation of portions of Zumbro Avenue and Colburn Drive.
Recommendation:
The Planning Commission reviewed this item at their July 6, 2023 meeting, and by a 5-0 vote, recommended approval to the Council.
Discussion:

The City of Shakopee is proposing an Annexation of portions of Zumbro Avenue Roadway Easement located south of CSAH 78, and portions of Colburn Drive Public Right-of-Way located North of Old Brick Yard Road and south of Mobile Manor Drive.

The Annexation of these public rights-of-way/roadway easements are necessary due to development of land adjacent to these roadways. D.R. Horton has received annexation, zoning and platting of property along Zumbro Avenue south of CSAH 78, but there is a portion of Zumbro Avenue that is still in Jackson Township that should be annexed into the city as this roadway will become a city road, with the city and developer responsible for the construction and maintenance of this roadway.

That is similar to the Colburn Drive right-of-way, which is adjacent to the River Valley Business Park and SPU developments, with that segment of Colburn Drive to be built and maintained by the developers & city.  As part of that development agreement with OPUS and Scott County, Colburn Drive will now exit to the north to prevent conflicts with the extension of the new road at CH69. A portion of this road was already annexed into the city when the Shakopee Public Utilities substation was annexed.

Jackson Township has requested that the city also annex the MNDOT rights-of-way to the north and staff will be bringing those parcels to the Planning Commission and City Council in August.  Staff will also coordinate with the township on maintenance of the adjacent roads for things like snow removal.

This application request would be consistent with the Orderly Annexation Agreement (OAA) approved between Jackson Township and the City (this is in Areas A, B & C of the OAA), which states that these areas are eligible for annexation any time after December 31, 2017. Should this annexation be approved, other conditions identified within this OAA document shall be applied.

Budget Impact:
N/A. The area of the proposed annexation is right-of-way/roadway easement which does not get taxed; therefore, there is no payment to Jackson Township for this property.
