Subject:
Public Hearing for Proposed Vacation of Sommerville Street Right-of-Way
Policy/Action Requested:
Adopt Resolution R2024-005, a resolution approving the vacation of a certain segment of Sommerville Street Public Right-of-Way.
Recommendation:
The Planning Commission reviewed this request at their January 4, 2024 meeting and unanimously recommended approval of the request.
Discussion:

The City of Shakopee has requested vacation of Sommerville Street Public Right-of-Way which would allow for the city to consolidate property associated with the River City Center (RCC). Presently, there is a segment of Sommerville, located north of 1st Avenue and south of Highway 101 that is still dedicated public right-of-way but is actually used as a driveway for the RCC (see attached site aerial).

The EDA and the city, as owners of the RCC and the land around the building, would like to clean up the outstanding title issues and once completed, replat the property into a single legal parcel.

Eventually the EDA and the CDA will create two condominium units with the land parcel as common area, with an interest split of 50/50.

Staff does not foresee any issues with this vacation. If approved, the city will have a title search completed and provide any necessary easements, and record the appropriate Plat/RLS for this property.
