| | | | | | | | Discussion: The City of Shakopee is proposing to amend Figure 4.60 - Metropolitan Urban Service Areas (MUSA) in the 2040 Comprehensive Plan. The proposal would amend the Existing MUSA Boundary to include property presently owned by Stuart Jacobson, Link Construction, Inc., and Garth & Catherine Kangas. These properties, with the recent annexation and zoning, would be the next natural expansion area of city services. These properties are located north of County State Aid Highway 78 and east of Marystown Road, and south of Countryside 2nd Addition (see attached aerial). The MUSA would consist of approx. 30 acres. If developed, staff anticipate subdivisions consisting of single family homes that would meet the R-1B zone regulations.
The following are the criteria evaluated in the granting of a Comprehensive Plan Amendment. The City Council may grant a Comprehensive Plan Amendment with a two thirds majority when it finds that one or more of the following criteria exists:
Criteria #1 The comprehensive plan was in error.
Finding #1 The original comprehensive plan should have been amended once these properties were annexed and zoned for single family development. This amendment remedies this error.
Criteria #2 Significant changes in community goals and policies have taken place.
Finding #2 Significant changes in community goals and policies have not taken place. This project would be consistent with the 2040 Comp Plan guiding.
Criteria #3 Significant changes in development patterns have occurred.
Finding #3 Significant changes in development patterns have not occurred.
Criteria #4 The Comprehensive Plan requires a different provision.
Finding #4 The Comprehensive Plan does not require a different provision.
Staff finds that the amendment meets 1 of the 4 criteria necessary to be approved by the City Council.
