|
| | | | | | | | | FROM: | Mark Noble, Senior Planner | | TO: | Planning Commission |
|
| | | | | | | | Subject: PUBLIC HEARING - Reguide and Rezone property to Highway Business (B-1) Zone; Reguide property to Commercial – 12321 Marystown Road |
| | | | | | | | Policy/Action Requested: Offer a motion of a positive recommendation to the City Council for the Rezoning of property to Highway Business (B-1) Zone and Reguiding of property to Commercial, and move its adoption. |
| | | | | | | | Recommendation: Planning staff did not receive any outside agency comments or concerns. Staff supports this request, as there are no outstanding issues/concerns with the request and it will be consistent with the surrounding property and with the suggested guiding as noted in the 2030 Comprehensive Plan (as it was located in Jackson Township and a staging plan was not adopted at that time, the 2030 Comp Plan only provided a suggested guiding for any future proposals). |
| | | | | | | | Discussion: Site Information
Applicant: City of Shakopee
Property Owner: Gregory Powers and the Irene Powers Estate
Location: 12321 Marystown Road
Current Zoning: County – Recently Annexed property
Adjacent Zoning: North: Highway Business (B-1) Zone
South: Urban Residential (R-1B) Zone
East: Highway Business (B-1) Zone
West: Medium Density Residential (R-2) Zone
Comp. Plan: Commercial (Suggested)
Lot Size: 3.4 Acres
Background
The City of Shakopee, on behalf of Gregory Powers and the Irene Powers Estate, has made application to Rezone property to Highway Business (B-1) Zone and Reguide property to Commercial. The property in question is 12321 Marystown Road, which is a single-family residence and 2 vacant parcels on approx. 3.4 acres, located at the northeast corner of 17th Avenue and CSAH 15/Marystown Road.
Mr. Powers is looking at development opportunities for this property. This property was recently annexed into the City; therefore, zoning and guiding need to be established for the property in question before he can pursue platting and development opportunities. The property most adjacent to this property is presently guided commercial and zoned Highway Business (B-1) Zone. Rezoning and guiding the Powers property consistent with the adjacent property and consistent with the 2030 suggested guiding is supported by City staff.
Considerations
The City Council may grant a zoning ordinance amendment when it finds that one or more of the following criteria exists:
1. The original zoning ordinance is in error.
2. Significant changes in goals in community goals and policies have taken place.
3. Significant changes in city-wide or neighborhood development patterns have occurred.
4. The comprehensive plan requires another provision.
Staff believe revising the zoning for this property meets more than one of the criteria.
