|
| | | | | | | | Subject: PUBLIC HEARING - Rezone property to Urban Residential (R-1B) Zone; Reguide property to Single Family Residential - 12800 Marystown Road |
| | | | | | | | Policy/Action Requested: Offer a motion of a positive recommendation to the City Council for the Rezoning of property to Urban Residential (R-1B) Zone and Reguiding of property to Single Family Residential, and move its adoption. |
| | | | | | | | Recommendation: Planning staff did not receive any outside agency comments or concerns. Staff supports this request, as there are no outstanding issues/concerns with the request and it will be consistent with the surrounding property and with the suggested guiding as noted in the 2030 Comprehensive Plan (as it was located in Jackson Township and a staging plan was not adopted at that time, the 2030 Comp Plan only provided a suggested guiding for any future proposals). |

Applicant: City of Shakopee
Property Owner: Friendship Baptist Church
Location: 12800 Marystown Road
Current Zoning: County – Recently Annexed property
Adjacent Zoning: North: Urban Residential (R-1B) Zone
South: Jackson Township
East: Jackson Township
West: Urban Residential (R-1B) Zone
Comp. Plan: Single Family Residential (Suggested)
Lot Size: Approximately 40 Acres
Background
The City of Shakopee, on behalf of Friendship Baptist Church, has made application to Rezone property to Urban Residential (R-1B) Zone and Reguide property to Single Family Residential. The property in question is 12800 Marystown Road, which is a church on approx. 40 acres, located at the northwest corner of County State Aid Highway (CSAH) 78 and CSAH 15/Marystown Road.
Friendship Baptist Church was built in approx. 2002, and presently is not utilizing all of their property; therefore, they are looking at development opportunities for some of their property. This property was recently annexed into the City; therefore, zoning and guiding need to be established for the property in question before he can pursue platting and development opportunities.
Considerations
The City Council may grant a zoning ordinance amendment when it finds that one or more of the following criteria exists:
1. The original zoning ordinance is in error.
2. Significant changes in goals in community goals and policies have taken place.
3. Significant changes in city-wide or neighborhood development patterns have occurred.
4. The comprehensive plan requires another provision.
Staff believe revising the zoning for this property meets more than one of the criteria.
