| | | | | | | | Shakopee Planning Commission Meeting April 5, 2018
|
| | | | | | | | | FROM: | Mark Noble, Senior Planner | | TO: | Planning Commission |
|
| | | | | | | | Subject: Vacation of Public Right-of-way and Drainage & Utility Easements |
| | | | | | | | Policy/Action Requested: Offer and pass a motion recommending approval of the vacation as recommended by staff. |
| | | | | | | | Recommendation: Staff recommends that the Planning Commission forward a recommendation of approval for the vacation of a public right-of-way (Shenandoah Drive) and public drainage & utility easements for property generally located North of Eagle Creek Blvd., East of Shenandoah Drive extended @ Eastway Avenue, South of 4th Avenue East and West of CSAH 83 @ 12th Avenue East consistent with the Easement Vacation Exhibits and Descriptions (with the exception of the water main only easement - document no. 139654), conditioned that the applicant provide the recommended easements to the public in their proposed Canterbury Park 7th Addition final plat as required by City Engineering and SPUC. |
| | | | | | | | Discussion: Doran Canterbury I, LLC is proposing a development on Canterbury Park property, west of the horse track and grand stand area. There exists a public right-of-way (Shenandoah Drive, established in Canterbury Park Sixth Addition) and several public drainage and utility easements that they would like to vacate (see attached Easement Vacation Exhibits and Descriptions). Additionally, they have submitted a Preliminary Plat and a Planned Unit Development Amendment for their proposed Canterbury Commons development, which will be presented to the Planning Commission and City Council for their consideration.
City departments, Scott County and other outside agencies were given the opportunity to review and provide comments regarding this application. City Engineering and SPUC support the requests, conditioned that the City and SPUC be provided easements as necessary within the Shenandoah Drive r.o.w. proposed for vacation and that new drainage & utility easements be provided consistent with the City and SPUC requirements with the proposed Canterbury Park 7th Addition final plat. One specific comment from SPUC that should be noted is that the water main only easement (per document no. 139654, located north of Eagle Creek Blvd. in the vicinity of the to be vacated Shenandoah Drive) should not be vacated. This easement encumbers this and the adjoining property so they wish to retain it for water main purposes in perpetuity regardless if a general utilities and drainage easement overlays it.
A public hearing has been set for Tuesday, April 17, 2018. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration.
