Randy Kubes, representing Roger and Susan Sames, property owners, has applied for a 2.5' side-yard setback variance from the required 10' to 7.5' for 31 lots and a 5' front yard setback variance from 30' to 25' for six lots (Lots 5-10, Block 3) in the proposed subdivision of Countryside 2nd Addition.
The applicant proposes to subdivide the property and incorporate the existing single-family house into one of the lots of the plat (see attached preliminary plat). Prior to the applicant applying to subdivide the property, the applicant and city staff had significant discussion on whether a cul-de-sac design was appropriate, or if a street connection to the adjacent property (see attached exhibit) is appropriate. Staff recommended a cul-de-sac to not create a narrow strip of land adjacent to the highway or future double frontage lots on Marystown Road on the property to the south when the street is extended. Since there is already two other street connections to the adjacent property, a third access isn't viewed as necessary. The proposed cul-de-sac allows for a more conventional lot design for future homeowners.
The location of the existing house and the proposed street design to accommodate the house limits the depth of the lots near the cul-de-sac, so the applicant is requesting a 5' front yard setback variance.
The applicant is also requesting a 7.5' side-yard setback to allow for flexibility in the construction design of houses. The recent plats of Windermere and Ridge Creek both have 7.5' side-yard setbacks. City staff intends to bring forward a text amendment regarding the setbacks in the R1B zone, as well as a modification to the R1C (Old Shakopee Residential Zone) to allow for future developments to utilize the R1C zone design standards. Currently the R1C zone regulations are limited to the areas described as near the traditional downtown area.
