Recommendation:
Staff Recommendation
Planning staff did not receive any outside agency comments or concerns. Staff supports this request, as there are no outstanding issues/concerns with the request and it will be consistent with the surrounding property and with the suggested guiding as noted in the 2030 Comprehensive Plan (as it was located in Jackson Township and a staging plan was not adopted at that time, the 2030 Comp Plan only provided a suggested guiding for any future proposals).

Planning Recommendation
On April 5th, the Planning Commission held a public hearing and reviewed the project, and by a 6-0 vote, forwarded a recommendation of approval regarding the applicant’s request, subject to compliance with Resolution No. R2018-042.

Introduction
The City of Shakopee, on behalf of Friendship Baptist Church, has made application to Reguide property for Single Family Residential land use. The property in question is located at 12800 Marystown Road, which is a church use on approx. 40 acres, located at the northwest corner of County State Aid Highway (CSAH) 78 and CSAH 15/Marystown Road.

Background
Friendship Baptist Church is looking at development opportunities for this property. This property was recently annexed into the City; therefore, zoning and guiding need to be established for the property in question before they can pursue platting and development opportunities.

Considerations
The City Council may grant a comprehensive plan amendment when it finds that one or more of the following criteria exists:

Criteria #1 That the original Zoning Ordinance is in error;

Finding #1 City zoning was not established for this property as it was under the jurisdiction of Scott County regulations until the recent annexation. The 2030 Comprehensive Plan’s suggested guiding is consistent with this request.

Criteria #2 That significant changes in community goals and policies have taken place;
Finding #2 Significant changes in community goals and policies that concern this property have taken place – the property has been annexed into the City of Shakopee from Jackson Township. The proposed request is consistent with the 2030 Comprehensive Plan’s suggested guiding.

Criteria #3 That significant changes in City-wide or neighborhood development patterns have occurred; or
Finding #3 Significant changes in development patterns have occurred for the subject property. Adjacent properties are presently being proposed for development of residential subdivisions, consistent with the West End Study Plan and current guiding/zoning guidelines.

Criteria #4 That the comprehensive plan requires a different provision.
Finding #4 The comprehensive plan is proposed to be amended by Resolution No. R2018-042 to adjust the guiding boundaries for this property for Single Family Residential use. Churches are listed conditional uses in residential zoning districts in Shakopee – this guiding is the most appropriate for the existing use.
