| | | | | | | | Subject: Rezone property at 12800 Marystown Road to Urban Residential (R-1B) Zone. | | |
| | | | | | | | Policy/Action Requested: Approve Ordinance No. O2018-004, an ordinance approving the Rezoning of property located at 12800 Marystown Road to Urban Residential (R-1B) Zone, and move its adoption. | | |
| | | | | | | | Recommendation: Staff Recommendation
Planning staff did not receive any outside agency comments or concerns. Staff supports this request, as there are no outstanding issues/concerns with the request and it will be consistent with the surrounding property and with the suggested guiding as noted in the 2030 Comprehensive Plan (as it was located in Jackson Township and a staging plan was not adopted at that time, the 2030 Comp Plan only provided a suggested guiding for any future proposals).
Planning Recommendation
On April 5th, the Planning Commission held a public hearing and reviewed the project, and by a 6-0 vote, forwarded a recommendation of approval regarding the applicant’s request, subject to compliance with Ordinance No. O2018-004.

Introduction
The City of Shakopee, on behalf of Friendship Baptist Church, has made application to Rezone property to Urban Residential (R-1B) Zone. The property in question is located at 12800 Marystown Road, which is a church use on approx. 40 acres, located at the northwest corner of County State Aid Highway (CSAH) 78 and CSAH 15/Marystown Road.
Background
Friendship Baptist Church is looking at development opportunities for this property. This property was recently annexed into the City; therefore, zoning and guiding need to be established for the property in question before he can pursue platting and development opportunities.
Considerations
The City Council may grant a zoning ordinance amendment when it finds that one or more of the following criteria exists:
Criteria #1 The original zoning ordinance is in error.
Finding #1 The property was recently annexed into the City of Shakopee; therefore, zoning needed to be established for the property consistent with the approved 2030 Comprehensive Plan, which tentatively guided this property for single family residential use. This guiding is consistent with the land use designation and zoning districts which allow churches.
Criteria #2 Significant changes in community goals and policies have taken place.
Finding #2 Significant changes in community goals and policies that concern this property have taken place. This property was recently annexed into the City of Shakopee; and zoning & guiding needs to be established for the property.
Criteria #3 Significant changes in development patterns have occurred.
Finding #3 Significant changes in development patterns have occurred for the subject property as a result of the annexation into the City of Shakopee. The property owner is pursuing development of some of their land consistent with the proposed zoning & guiding, which is also consistent with the most adjacent property which is also available for development.
Criteria #4 The Comprehensive Plan requires a different provision.
Finding #4 The proposed guiding is consistent with the approved 2030 Comprehensive Plan.
