Downtown has larger public rights of ways and plazas that would facilitate outdoor dining and drinking, enhancing the customer's experience during the summer months.  Currently some encroachments have been occurring with no permits and often there are conflicts with the ROW and ADA access along with possible liquor violations. 

The Downtown Businesses have requested this and it is supported by Downtown Shakopee (Main Street). This will allow staff to ensure that proper access is maintained while also limiting the city's liability through being added as an additional insured.

Cities throughout the Metro Area have very similar Ordinances and we have adopted ours from the City of Carver that recently adopted a very similar ordinance. 

Also attached is the proposed application.  Planning staff will review.  We are working to set these up through our electronic permitting system and will also coordinate with the City Clerk on liquor licensing.
