FROM:Steve Lillehaug, City Engineer/Public Works Director

Subject:
Americans with Disabilities Act (ADA) Transition Plan for Public Right-of-Way.
Policy/Action Requested:
Approve Resolution R2018-072, adopting the ADA Transition Plan for Public Right-of-Way.
Recommendation:
Approve Resolution R2018-072.
Discussion:

The Americans with Disabilities Act (ADA), enacted in 1990, is a civil rights law prohibiting discrimination against individuals on the basis of disability. Title II of ADA pertains to programs, activities and services provided by public entities. As a public entity that provides public transportation services and programs, the City of Shakopee is expected to comply with this section of the Act.

In accordance with the section pertaining to the infrastructure within public right-of-way, a policy and plan must be in place to "transition" the facilities to become compliant with ADA guidelines. The state's Local Road Research Board developed a template ADA Transition Plan to be used by cities to develop their plans.

City staff used this template to develop the City of Shakopee's ADA Transition Plan for Public Right-of-Way. The city's proposed Transition Plan provides an inventory of existing facilities and a plan for how non-compliant facilities will be brought into compliance by integrating ADA improvements into the city's Capital Improvement Plan.

In addition to the transition plan for public right-of-way, the city will also need to develop ADA transition plans for city parks/playgrounds and a transition plan for city facilities and buildings. It should also be noted that receiving future federal funding for infrastructure projects is expected to be contingent upon jurisdictions having an approved ADA transition plan.

Budget Impact:
Recommended ADA pedestrian improvements are proposed to be coordinated and integrated with CIP projects, to the extent feasible, to obtain the best prices for those improvements. In previous CIP projects, these type of improvements have not always and fully been included. Therefore, a budget impact will be noticed in future CIP projects that include pedestrian facilities. With an approximate total of 1,572 pedestrian ramps throughout Shakopee not in compliance with ADA requirements, the total cost to improve these facilities is estimated to be $9,500,000. The proposed goal included in the plan is to complete the recommended ADA improvements with 20 years.
