C.4, Hourly Restrictions on Certain Operations, allowing Vierling Drive Phase 2 project contractors to perform work from 8 a.m. to 9 p.m. on Saturdays through the end of September 2018; and allowing the County's sealcoat project contractor for County Road 101 to perform work from 7 a.m. to 9 p.m. on Saturday, June 30 and Sunday, July 1, 2018.
Recommendation:

Approve the requested action.

Discussion:

City Code Section 130.45 restricts the hours of construction operation from 7 a.m. to 10 p.m. on weekdays, and 9 a.m. to 9 p.m. on weekends and holidays.

Contractors working on the Vierling Drive Phase 2 project have requested the city to extend working hours to begin work at 7 a.m. on Saturday mornings through the end of September 2018. However, there are adjacent residential areas so an 8 a.m. start time is being recommended for this area.

The contractor for the County's sealcoat project on County Road 101 has requested the city to extend working hours to begin work at 7 a.m. on Saturday, June 30 and Sunday, July 1, 2018. The project area is prescribed between Marschall Road (County Road 17) easterly to TH 169. The goal of the contractor is to start early on the westbound stretch from TH 169 towards Valley Fair, completing most of the work in that area prior to Valley Fair traffic arriving for a 10 a.m. opening.

These extensions will help meet the project deadlines including minimizing the length of the traffic impact. The impacts from the earlier generated noise is not anticipated to be a substantial nuisance in these areas of the city for the prescribed times. If property owner complaints are received by the City, the ordinance suspension can be revoked at the discretion of the City Engineer. The Vierling project is scheduled to be completed by September 2018; the county project is expected to be substantially completed within the two days prescribed.

With Council's approval, a public news release and notice to meet the City Code requirements would be placed in the Shakopee Valley News and on the City's website.

Budget Impact:
None.
